From a qualitative approach, which rescues the voice of civil servants, we conclude that the same State, with a single consultation regulation, designs and implements two processes with strong discursive, practical and territorial differences. As the theory puts it, the success of these processes lies largely in the political will of the actors to seek greater dialogue and cultural relevance. Este artículo busca describir políticas públicas tendientes a garantizar los derechos indígenas en Chile a partir de analizar la implementación del derecho a consulta previa, libre e informada (Convenio OIT 169, artículo 6) a través de dos procesos desarrollados por el Estado: (1) la creación del Ministerio de Asuntos Indígenas, desarrollado por el Ministerio de Desarrollo Social y (2) la consulta previa sobre un borrador de indicación sustitutiva que crearía el Ministerio de Cultura, Arte y Patrimonio, desarrollada por el Consejo Nacional de la Cultura y las Artes. Desde un enfoque metodológico cualitativo, que rescata la voz de los funcionarios, se concluye que un mismo Estado, con un reglamento único de consulta, diseña e implementa dos procesos con fuertes diferencias discursivas, prácticas y territoriales. Como lo plantea la teoría, el éxito de estos procesos radica en la voluntad política de los actores de buscar mayor diálogo y pertinencia cultural.
