oai:ojs2.localhost:article-5172019-02-05T20:14:38Z Implementation of the indigenous consultation by the Chilean state:: The case of the Ministerio de Desarrollo Social and del Consejo Nacional de la Cultura y las Artes Implementación de la consulta indígena por el estado chileno:: El caso del Ministerio de Desarrollo Social y del Consejo Nacional de la Cultura y las Artes de Cea Pé, Maite Peralta García, Camila This article seeks to describe public policies tending to guarantee indigenous rights in Chile, specifically based on the analysis of the implementation of the right to prior, free and informed consultation (article 6 from ILO 169 Convention) through two parallel processes of indigenous consultation developed by the Chilean State: 1) The creation of the Ministry of Indigenous Affairs and the Council (s) of Indigenous Peoples developed by the Ministry of Social Development and 2) The prior consultation on a draft that would create the Ministry of Cultures, Arts and Heritage. From a qualitative approach, which rescues the voice of civil servants, we conclude that the same State, with a single consultation regulation, designs and implements two processes with strong discursive, practical and territorial differences. As the theory puts it, the success of these processes lies largely in the political will of the actors to seek greater dialogue and cultural relevance. Este artículo busca describir políticas públicas tendientes a garantizar los derechos indígenas en Chile a partir de analizar la implementación del derecho a consulta previa, libre e informada (Convenio OIT 169, artículo 6) a través de dos procesos desarrollados por el Estado: (1) la creación del Ministerio de Asuntos Indígenas, desarrollado por el Ministerio de Desarrollo Social y (2) la consulta previa sobre un borrador de indicación sustitutiva que crearía el Ministerio de Cultura, Arte y Patrimonio, desarrollada por el Consejo Nacional de la Cultura y las Artes. Desde un enfoque metodológico cualitativo, que rescata la voz de los funcionarios, se concluye que un mismo Estado, con un reglamento único de consulta, diseña e implementa dos procesos con fuertes diferencias discursivas, prácticas y territoriales. Como lo plantea la teoría, el éxito de estos procesos radica en la voluntad política de los actores de buscar mayor diálogo y pertinencia cultural.
